1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you", or "your") and TekSpert LTD ("TekSpert", "we", "us", or "our") regarding your use of our website, mobile application, and electrical services.

By accessing our website at tekspert.co.uk, using our mobile application, booking our services, or engaging with us in any capacity, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use our services.

2. Services Provided

TekSpert provides professional electrical services across Northwest England, including but not limited to:

  • Emergency Electrical Services: 24/7 emergency call-out services for urgent electrical issues
  • Electrical Installations: New electrical installations for domestic and commercial properties
  • Rewiring Services: Complete or partial rewiring of properties
  • Electrical Testing: EICR testing, safety inspections, and certification
  • Fault Finding & Repairs: Diagnosis and repair of electrical faults
  • PAT Testing: Portable Appliance Testing for businesses and landlords
  • Fuse Board Installations: Consumer unit replacements and upgrades
  • Additional Services: As described on our website or agreed in writing

All electrical work is carried out by qualified, Part P certified engineers in compliance with BS 7671:2018+A2:2022 (18th Edition Wiring Regulations) and relevant UK building regulations.

3. Booking and Appointments

3.1 Booking Process

  • Bookings can be made via our website, mobile app, phone, or email
  • Emergency bookings require immediate payment or payment card authorization
  • Planned services may require a deposit (typically 25-50% of quoted price)
  • All bookings are subject to engineer availability and service area coverage

3.2 Emergency Response Times

Emergency response times are provided as estimates only:

  • Within 1 Hour: Target response; not guaranteed
  • Within 4 Hours: Target response; not guaranteed
  • Within 12 Hours: Target response; not guaranteed

Response times may be affected by traffic, weather conditions, engineer availability, and location. We will make every reasonable effort to meet the target response time. If we cannot attend within the selected timeframe, we will contact you to reschedule or offer a refund.

3.3 Access Requirements

You must:

  • Provide safe and reasonable access to the property and work area
  • Ensure someone over 18 is present during the service
  • Provide accurate property and contact information
  • Disclose any known hazards (asbestos, structural issues, etc.)
  • Ensure pets are secured away from the work area

3.4 Cancellations and Rescheduling

  • More than 24 hours notice: Full refund or free rescheduling
  • Less than 24 hours notice: 50% cancellation fee
  • Less than 4 hours notice or no-show: 100% cancellation fee
  • Emergency bookings: Non-refundable call-out fee if cancelled after engineer dispatch

We reserve the right to cancel or reschedule appointments due to unforeseen circumstances. In such cases, we will provide as much notice as possible and offer alternative arrangements or a full refund.

4. Pricing and Payment

4.1 Pricing

  • All prices are quoted in British Pounds Sterling (GBP)
  • Prices include VAT at the current UK rate (20%)
  • Emergency call-out fees are fixed as advertised
  • Additional work beyond the initial call-out will be quoted before commencing
  • Written quotes are valid for 30 days unless otherwise stated
  • Prices may be adjusted for materials cost fluctuations on quotes over 30 days old

4.2 Payment Terms

  • Emergency Services: Payment required in full at time of booking or upon completion
  • Planned Work: Deposit required upon booking, balance due on completion
  • Commercial Contracts: Net 30 days for approved business accounts
  • Payment Methods: Credit/debit cards, bank transfer, cash, or business account

4.3 Late Payment

For business customers with credit terms:

  • Interest charged at 8% above Bank of England base rate on overdue amounts
  • £40 late payment administration fee for debt recovery costs
  • Right to suspend further services until account is settled

4.4 Additional Costs

Additional charges may apply for:

  • Work outside standard hours (evenings, weekends, bank holidays)
  • Parking fees at the service location
  • Specialist equipment hire or unusual materials
  • Aborted visits due to customer unavailability
  • Additional work discovered during service delivery

You will be informed of any additional costs before they are incurred, where reasonably practicable.

5. Work Standards and Compliance

5.1 Qualifications and Standards

All electrical work is performed:

  • By qualified electricians holding relevant City & Guilds qualifications
  • In accordance with BS 7671:2018+A2:2022 (18th Edition Wiring Regulations)
  • In compliance with Part P Building Regulations
  • Following IET Guidance Notes and manufacturer instructions
  • Using appropriate testing equipment calibrated within the last 12 months

5.2 Certification

  • Minor Works Certificates provided for minor additions and alterations
  • Electrical Installation Certificates for new installations and consumer unit replacements
  • EICR (Electrical Installation Condition Report) for testing and inspection
  • PAT Testing certificates and asset registers
  • All certificates issued digitally and via post upon request

5.3 Safety Notices

If our engineers identify unsafe electrical installations or conditions:

  • We will inform you immediately
  • Provide written details of the hazard
  • Recommend remedial action
  • We may refuse to carry out work if it would be unsafe or non-compliant

6. Warranties and Guarantees

6.1 Workmanship Guarantee

  • 12-month warranty on all workmanship from date of completion
  • Covers defects arising from our installation or work
  • Does not cover normal wear and tear, misuse, or damage by third parties
  • Does not cover pre-existing faults or conditions

6.2 Parts and Materials

  • Parts carry manufacturer's warranty (typically 1-10 years depending on item)
  • We will assist with manufacturer warranty claims
  • Warranty may be void if parts are tampered with or modified

6.3 Warranty Exclusions

Our warranty does not cover:

  • Damage caused by subsequent work by others
  • Alterations or modifications made after our work
  • Failure to maintain the installation in accordance with regulations
  • Acts of God, flooding, fire, lightning strikes
  • Power surges or supply issues from the electricity network

7. Liability and Insurance

7.1 Our Insurance

We maintain:

  • Public Liability Insurance: £5,000,000
  • Professional Indemnity Insurance: £2,000,000
  • Employers' Liability Insurance: £10,000,000

7.2 Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability for any claim is limited to the amount paid for the specific service
  • We are not liable for indirect, consequential, or economic losses
  • We are not liable for losses resulting from your failure to follow our advice
  • Claims must be notified to us within 30 days of discovery

7.3 Exceptions

Nothing in these Terms limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded by law

7.4 Your Responsibilities

  • Maintain adequate property insurance
  • Notify your insurer of any electrical work undertaken
  • Take reasonable care of completed work
  • Report any issues promptly to allow timely resolution

8. Consumer Rights

Under the Consumer Rights Act 2015, you have the right to expect that services are:

  • Performed with reasonable care and skill
  • Performed within a reasonable time (if no specific time agreed)
  • Charged at a reasonable price (if no specific price agreed)
  • As described in our marketing and communications

If our service does not meet these standards, you may be entitled to:

  • Request repeat performance of the service
  • Receive a price reduction
  • Request a full or partial refund

These statutory rights are not affected by our terms or warranties.

9. Intellectual Property

All content on our website and mobile application, including text, graphics, logos, images, software, and design, is the property of TekSpert LTD or our licensors and is protected by UK and international copyright and trademark laws.

  • You may not reproduce, distribute, or create derivative works without written permission
  • You may print or download content for personal, non-commercial use only
  • "TekSpert" and our logo are registered trademarks
  • Unauthorized use may result in legal action

10. User Accounts

If you create an account on our website or mobile app:

  • You must provide accurate and complete information
  • You are responsible for maintaining account confidentiality
  • You are responsible for all activities under your account
  • You must notify us immediately of any unauthorized access
  • We may suspend or terminate accounts that violate these Terms
  • You may close your account at any time

11. Prohibited Uses

You agree not to:

  • Use our services for any illegal purpose
  • Transmit harmful code, viruses, or malware
  • Attempt to gain unauthorized access to our systems
  • Scrape or harvest data from our website
  • Impersonate TekSpert or our engineers
  • Post false, misleading, or defamatory content
  • Interfere with other users' access to our services
  • Use our services for competitive research or analysis

12. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including:

  • Acts of God (severe weather, earthquakes, floods)
  • War, terrorism, civil unrest
  • Government restrictions or regulations
  • Pandemics or epidemics
  • Industrial action or strikes
  • Failure of utilities or telecommunications
  • Supplier or sub-contractor failures

In such events, we will notify you as soon as reasonably possible and make efforts to minimize disruption.

13. Complaints Procedure

If you are dissatisfied with our service:

  2. Provide details of the issue, booking reference, and supporting evidence
  3. We will acknowledge your complaint within 2 business days
  4. We will investigate and respond with a resolution within 14 days
  5. If you remain unsatisfied, you may escalate to a director

If we cannot resolve your complaint, you may refer it to:

  • The Electrical Safety Register (for safety concerns)
  • NICEIC (if applicable)
  • Consumer Rights organizations
  • Alternative Dispute Resolution (ADR) services

14. Data Protection and Privacy

Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to our Privacy Policy.

15. Termination

We reserve the right to:

  • Refuse service to anyone for any lawful reason
  • Terminate or suspend accounts that violate these Terms
  • Discontinue services with reasonable notice
  • Modify or discontinue website features

Termination does not affect obligations arising before termination, including payment obligations.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

For consumers, nothing in these Terms affects your statutory rights, including rights under consumer protection legislation.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Material changes will be notified to registered users via email.

Your continued use of our services after changes constitutes acceptance of the modified Terms. We recommend reviewing these Terms periodically.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be replaced with a valid provision that most closely matches the intent of the original provision.

19. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and TekSpert regarding your use of our services. They supersede all prior agreements, understandings, and communications.
